EMV Shift Liability Chargebacks

I have had a few chargebacks that I challenged with signed receipts and lost with a variation of the EMV liability shift verbiage as the reason. In each of these cases they were from tabs where he had pre-authorized the credit card and then closed out to the saved credit card. My concern is since you start tabs by swiping the card that this is the reason we are losing even though we have signed slips. Is Toast planning to update to allow you to start tabs using the chip?
