Toast Time Clock and California Double Time Reporting

I have. an issue with Toast Time Clock reports.   Toast Support seems to not understand
this is not  a feature add. But a possible legal exposure to all Toast California Business may have if they are not using Toast
payroll in conjuntion with TOAST POS.   If you are manual  running Payroll off Toast Reports today and using  another vendor payroll system ( not integrated with Toast)   Doubletime not being broken out in Toast Reports

 Being a  California Based small business.  We have  California added double time rules for hours worked and paid.   

1.  Work on 7the consecutive  day is double time. after  9th hour  - 24 (base hourly  rate x 2.0 )  * double time hours works 

2. Work over 12 hours in a day and after 12 hours is double time.  (base hourly  rate x 2.0 )  * double time hours works 

Plus the 2  standard 40 hours over is overtime  and over 8 hours in a day up to 12 hours is overtime 
(base hourly  rate x 1.5 )  * overtime  hours works 


I want to be clear overtime and double time are two different pay rates for hours worked in California.


I have know since we had Toast that Toast allows me to configure overtime and doubletime  pay rates.  Which i have 

2 overtime and 2 double time rates of pay based on clock in out 

I am lucky since we are only open 6 days a week we do not run into the 7 day double time pay .

I do have on a rare occasion have staff pull a 12 hours shift of work.  Generally if another staff calls off they 
will work to keep  our baked goods made.  I have to manually review the time clock entry report for 2 of my staff
for any double time hours clock.

i have called toast support and they state if I use Toast Payroll my double time rules will be applied to paycheck they process.  This is all well and good but I do not use Toast payroll.  I have used a different company that is California based to help in keep up with all the issue with the Californai State law changes. 


As a real example of clock in and out  by my employee   we change his name to John  Smith.    He ran over the 12 hours in a day of work and this is a double time pay event. 

He work one day. clock in at 8:39 am and clock out same day at 9:47pm.  He normally not work this long but our other baker was out that day.  

He took his required rest amd meal breaks.  So we worked payable hours on toast report was  12.14, His regular hours was reported as 8.00 and his over time hours was report at 4.14  ( this is incorrect for overtime pay) .

All this was correct up to there is no  overtime hours report in Toast reports.   As I said in start Toast is not showing Double time hours worked in any back office system report or add a column to report feature. 

The correct report  should have broken out the double time hours he work of .14 to double time of .14 in a Toast report which there is none today, 


I have open a case with toast a week ago and they said i need to use their payroll to fix this.  closed ticket.  I open another case last week  and added the report showing 4.14 overtime.  Asked again what report shows my california specific double time rule of over 12 hours?   first level support and second level support had not answer.  I was being transfered to an expert yesterday at 6pm by Dave and the call was disconnected.  As of today i have not call back from Toast on my case. 

I only want ot give a heads up for anyone  that is  a  small business owner like myself  using Toast time Clock  Repoera and not with Toast  payroll add on.  You using some other payroll system.  You need to check for any double time evnet manually for your staff if they run into it even once.  You are not seeing double time hours broken out  in any in Toast Reports today.  So you maybe pay out the overtime rate of 1.5 x hourly salary, when in reality your are required to pay 2.0  x hourly rate ( in California) 

I monitor my time clock report  for the double time today.    So I pay out correctly.    

Further Toast will need to work to update this since the Big Beatiful Bill will allow employee to deduct overtime pay . ( which as of this moment is only the Federal 40 hours over overtime.  I have to back out my staff overtime and double time and report that on  W2 filings next years.  So Toast needs to basically add a reporting  to all time reports based on Overtime rules I setup   Which i. have 4 today.  This would solve many issues and worries of under reporting pay rate in payroll.  I not going to even go into the legal exposure.

thanks the other report seems to show what i need.  

I have a case open on the DT reports in reference to my situation with Toast.  Yes depending our your state. OT & DT is different .   Toast  is aware of the DT issue and is working on the DT report to better match California requirements.  This is for Double Time reporting which some states have different requirements for pay.


Hi Rob, I understand the complexities, however Toast calculates the TOTAL $$$ properly when calculating regular and double OT.. all it needs to do is add another column on the Labor Summary report that shows the DT hours. Seems simple enough.
